In a later affidavit filed in March, Wright stated that key proof regarding the alleged breach had been submitted by his attorneys at Ontier with out his permission, and constituted legally privileged materials. Confronted with a 17,000-word skeleton argument superior by Wright’s new attorneys, buttressed by 1,600 pages of authorized authorities, Warby concluded that the price of persevering with outweighed the advantages.
